yes but it is also this exact problem that keeps them from being able to produce and successfully market a truly adult game
sad as it is (i feel like a bucky eg old man here) the problem needs to be addressed in a sensible way that keeps parents informed about what there children see, read, or enteract with. without taking away the rights of the older gamers
perhaps like the old video stores where the adult videos were kept in a separate room and you had to show your id to enter (waited for 5 years to get in that damn room and was very dissapointed before you all can flame me)
anyway until something is done to keep the conserative masses (nxs included) happy about procautions being taken we will never hear the end of the madness that continues to blame everything bad on video games, music, movies, and tv instead of on the parents where it belongs! imho and to top it all off we will never see what games like duke nukem could really be instead we will have to deal with *ehem* moderated verisons of the game we like.
