Well GunMetal and Impossible Creatures where released before the release of any Directx9 compatible vga card if my memory serve

And you think the developers don't get access to sdks before your average joe schmoe?

Also, keep in mind that Impossible Creatures was released by Microsoft, and GunMetal is pretty much nvidia's Cg (hand-in-hand with dx9) showoff game..
