Importing Illegal?

I can't really understand latest statment from Nintendo saying they will take conter measures if imported quantities by retailers are going to be huge.

What's illegal about buying something in the usa and playing it in UK (i.e.), when your gameboy advance can play it without any problem?

Not forgetting Datel's Freeloader is legally for sale to get usa/jap cube games to be playable on pal consoles.

After all, is it END-USER fault if nintendo takes 5 months more to bring Metroid Prime in Europe compared to usa counterpart?
